we are aware that these laws may differ from usa and other countries, but as we are uk based we are obliged to abide by them and adhere to their content.

fraudulent mediums act 1959
 

An Act to repeal the Witchcraft Act, 1735 and to make, in substitution for certain provisions of section four of the Vagrancy Act 1824, express provision for the punishment of persons who fraudulently purport to act as spiritualistic mediums or to exercise powers of telepathy, clairvoyance or other similar powers.

Be it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Punishment of fraudulent mediums, & co

1.-

    (1) Subject to the provisions of this section, any person who-

      (a) with intent to deceive purports to act as a spiritualistic medium or to exercise any powers of telepathy, clairvoyance or other similar powers, or

      (b) in purporting to act as a spiritualistic medium or to exercise such powers as aforesaid, uses any fraudulent device,

    shall be guilty of an offence.

    (2) A person shall not be convicted of an offence under the foregoing subsection unless it is proved that he acted for reward; and for the purposes of this section a person shall be deemed to act for reward if any money is paid, or other valuable thing given, in respect of what he does, whether to him or to any other person.

    (3) A person guilty of an offence under this section shall be liable on summary conviction to a fine not exceeding (the prescribed sum) or to imprisonment for a tern not exceeding four months or to both such fine and such imprisonment, or on conviction on indictment to a fine... or to imprisonment for a term not exceeding two years or to both such fine and such imprisonment.

    (4) No proceedings for an offence under this section shall be, brought in England or Wales except by or with the consent of the Director of Public Prosecutions.

    (5) Nothing in subsection (1) of this section shall apply to anything done solely for the purpose of entertainment


Repeals.

2.-

    The following enactments are hereby repealed, that is to say-

    9 Geo. 2. c.5 . (a) the Witchcraft Act 1735, so far as still in force, and

    5 Geo. 4. c. 83 (b) section four of the Vagrancy Act 1824 so far as it extends to persons purporting to act as spiritualistic mediums or to exercise any powers of telepathy, clairvoyance or other similar powers, or to persons who, in purporting so to act or to exercise such powers, use fraudulent devices.

NEW LAW CHANGES 2008

new law changes in 2008 mean that you can be liable for a hefty fine and/or prison, it comes under consumer protection regulations,this means that unless you give exactly what you say you can offer, you can be investigated by trading standards, whose officers can deal with as they see fit, so depending on who is investigating you as to how they deal with the complaint.

These laws mainly affect those who recieve money for their reads, but also donations and gifts are included as 'payment'.the new laws also suggest you need to be able to justify what you are offering, e.g if you offer healing you must be able to give proof of such claim.

lots of people are under the impression they are genuine so therefore are safe from being investigated and receiving the consequences, this is not true , it only takes one person to have a misunderstanding or misinterpretation of what you have said to make a complaint against you.

for example: a reading takes place to a wife, the wife decides from the reading she feels the right way forward is to divorce the husband, the reading is mentioned, so the husband complains you are acting against the regulations and its affected his marriage- its easily done and you dont even need to know the person making the complaint!(in this case the husband), it really could land you in all sorts of problems.

the new law also says that mediums/psychics should say they are for entertainment purposes only so that pople are aware that it can neither be proved or disproved, a lot of petitions and demonstrations have been held because mediums/psychics beleive they have to state they are not genuinely reading, instead of telling people the way it is.

the spiritual workers association currently have a E petition in place to bring in new legislation for genuine mediums/psychics as there is no protection for those who are genuine , their petition can be found at:http://petitions.pm.gov.uk/spiritualworkers/ and will be entered to downing street

here are a few tips or do's and dont'sto try and protect you from going against these regulations:-

*Always give the information as you receive it, it is not for you to understand , it is for the person having the reading to make sense of.

*should the person/sitter not be able to confirm details of the read under no circumstances force it upon them or bully them,as long as you have said whats given , it for them to work out what it means , and often things dont make sense until after .

*always try and use the wording given and not adapt it , the person is meant to understand ,the way it is said will often be how the spirit person would have said it- we all have our own languages and words we use!

*never on any account predict- this is against the law under the fraudulent mediums act 1959, paths are always changing so to predict would be wrong and the sitter may perceive it as gospel.

*children under the age of 18 should not be read, this has been common for many years now as the child is deemed as vulnerable, you could tell a child something and their path changes,it doesnt happen and a parent or family member sues you out of concern- its way too risky so dont go there, it could lead from innocent to really being in trouble as courts will automatically see the child as vulnerable, same goes for those whose mental capacity isnt the norm( POVA- protection of vulnerable adults will more than likely apply).This is the main reason why peacefulsouls will not allow anyone under the age of 18 to register, whilst the child may seem grown up in mind they are still very fragile,imagine if somebody gave your child a reading you didnt like , how would you feel?this is for your protection and any good medium /psyhcic would not do such a thing.

*keep development up to date, you always learn new things so be aware it is not just a case of learning once it is a lifetime process.

*never prescribe or diagnose a problem, sitters should always be diagnosed by  a proffessional doctor or consultant, and very risky to diagnose such a problem, its better to say i feel this could do with  a check up- the sitter may  get so worried it makes them ill!

please remember if you are reading, at the end of the day you really dont know who you are talking to over the internet, you could be reading a trading standards investigator and face presecution , so its important to do things right and in the right way to keep yourself above board and to make you professional at what you do, it is such a gift you are given so respect what you have been given and look after it the way you would a sentimental object.
